3. Use of the Service

Monarcha grants you a limited, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms. You agree not to:

• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any part of the Service

4. User Content

You retain ownership of all data, files, maps, and other content you upload to the Service (“User Content”). By uploading User Content, you grant Monarcha a limited license to process, store, and display that content solely for the purpose of providing the Service to you.

You are solely responsible for your User Content and represent that you have all necessary rights to upload it. Monarcha does not claim ownership of your User Content.

5. Intellectual Property

The Service, including its design, code, algorithms, models, documentation, and branding, is owned by Monarcha and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written permission.

6. Payment and Billing

Certain features of the Service may require payment. If you subscribe to a paid plan, you agree to pay all applicable fees as described at the time of purchase. Fees are non-refundable unless otherwise stated. We reserve the right to change pricing with reasonable notice.

Payments are processed through Stripe. We do not store or process payment card data ourselves. Stripe's terms and privacy policy apply to payment processing.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free access. We may modify, suspend, or discontinue any part of the Service at any time with or without notice. We are not liable for any downtime or service interruptions.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MONARCHA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT THE RESULTS OBTAINED WILL BE ACCURATE OR RELIABLE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONARCHA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF MONARCHA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify and hold harmless Monarcha, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination will survive.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.
